If accused has right to silence, cops have right to arrest: SC

NEW DELHI: Accused of not answering any questions relating to a land-grabbing case, counsel for Sumit Roy, the PA to TMC general secretary Abhishek Banerjee, attempted to brush the issue aside Wednesday by saying the accused had a constitutional right to remain silent. He was, however, countered by Supreme Court, which said the police had an equal right to arrest.Solicitor general Tushar Mehta submitted in sealed cover the details of the modus operandi adopted by Roy in the Salboni land-grabbing case, in which Calcutta HC had refused him anticipatory bail. On appeal, SC had granted him interim pre-arrest bail on the condition that he would present himself before the investigation officer daily and cooperate with the probe.Mehta said though Roy appeared before the IO, he refused to answer the questions posed to him.
